Is it possible to legally grow marijuana plants at home in Poland? The exact answer to this question is not known to everyone. Currently, marijuana is one of the most popular and at the same time one of the most controversial plants in the world. It is worth getting acquainted with the regulations on marijuana that apply in our country - Poland. Restrictions on the cultivation of hemp, including cannabis, i.e. marijuana, result from the Act of 29.VII.2005 on counteracting drug addiction.
What does the law say about growing marijuana plants?
Discussing the above We will start by specifying and explaining some concepts. According to the law, hemp is a plant of the genus Cannabis L. The legislator mentions fibrous hemp several times in the act, referring to hemp plants (Cannabis sativa L.). Seed hemp is characterized by the fact that the sum of the content of delta-9-tetrahydrocannabinol and tetrahydrocannabinolic acid (delta-9-THC-2-carboxylic acid) in the flowering or fruiting tops of plants from which the resin has not been removed, does not exceed 0,30% on a dry weight basis. In a word, these are hemp that have no psychoactive effect after consumption. You can say that they are such a non-alcoholic beer in the world of cannabis. They smell and taste almost the same, but there is no so-called after them. phases. It is worth remembering, however, that hemp, thanks to the content of other non-psychoactive cannabinoids, including CBD or CBG, which are not regulated in the Act, have a number of health-promoting properties.
What hemp can be grown in Poland?
Article 45 paragraph 3 of the discussed act, clearly indicates that hemp can be grown only for the needs of the following industries: textile, cellulose and paper, pharmaceutical, cosmetic, chemical, food, construction materials and seed. The next paragraph makes it clear that the cultivation of hemp for purposes other than those listed in paragraph 3 is prohibited.
As can be seen from the above provision, in our country, the cultivation of hemp other than fibrous is prohibited. The legislator, as of today, has not even provided for the possibility of growing marijuana for medical purposes, whether by an ordinary citizen or a company. However, things have moved forward in this regard. At the beginning of February 0, the Sejm passed one of the laws on the production of medical marijuana in Poland. Unfortunately, according to many experts, including members of the Parliamentary Team for the Legalization of Marijuana, this law leaves much to be desired. Only research institutes will be able to grow and harvest medical marijuana, of course after obtaining the consent of the chief pharmaceutical inspector. We keep our fingers crossed for the new regulations to come into force as soon as possible and for them to have a positive impact on the prices of medical marijuana and its availability. What are the limits to cannabis cultivation?
In addition to the above industrial needs, the cultivation of fibrous hemp can be carried out only in designated areas, on a specific area - and all this is done on the basis of a cultivation permit and only with the use of seeds (seed) from the basic category or from the certified category (within the meaning of the provisions on seed production). In addition, in order to legally cultivate hemp in Poland, a permit must be obtained. Such a permit can be obtained by both a farmer, an entrepreneur and an ordinary citizen who wants to use the plant on their own.
Is it possible to plant 1 marijuana bush at home?
Regardless of whether we have 1 pot or, for example, 1 hectare of sown cannabis, we are breaking the law. This is mentioned in the Act on counteracting drug addiction in Article 4 point 28. There are countries where 1-5 marijuana plants are considered as cultivation for own needs and there is no penalty for this. The community in Poland is also fighting for such solutions. So far, these and similar proposals have not been adopted by the Sejm.

Hemp varieties suitable for such cultivation should have a CBD content. Typically, the best CBD seeds come from sativa, which has a high level of cannabidiol but a low THC content. The European Union provides an up-to-date list of varieties of legal hemp. Familiarize yourself with it before growing to avoid trouble and unnecessary expenses, e.g. for uncertified seeds.
Breeding conditions
The CBD bush needs a lot of light, heat and moisture to grow properly. It is worth providing the plant with the right amount of light, as well as good fertilizer and soil with the right structure.
Flowering period
The flowering period of a CBD bush usually lasts from 8 to 12 weeks. During this time, it is important to water the plant regularly and provide it with the right amount of nutrients. Keep an eye on whether your plant is male or female, as certified cannabis seeds tend to be regular.
Harvesting and drying hemp flowers
After approximately 12 weeks of flowering, the plant is ready to be harvested. It is best to start by picking the largest flowers and then gradually work your way up to the smaller ones. Flowers should be dried in a dark and dry place for about 7-10 days.
What is the penalty for illegally growing cannabis?
The penalty for cultivating cannabis is defined in Article 63(1) of the Act on Counteracting Drug Addiction, which states that:
- who, contrary to the provisions of the Act, cultivates hemp, with the exception of fibrous hemp, is subject to imprisonment for up to 3 years.
- Anyone who, contrary to the provisions of the Act, collects hemp resin or herb other than fibrous (paragraph 2) is subject to the same penalty.
- A person who commits a crop that can deliver a significant amount non-fibrous hemp resin or herb is subject to imprisonment from 6 months to 8 years (paragraph 3).
