Any ongoing criminal or preliminary proceedings related to such cases will also be discontinued.

In the second phase of the plan, commercial cannabis distribution networks will be tested in selected municipalities in different states, covering the entire process from production to distribution and final sale in dedicated points. The possibility of conducting experiments with the sale of cannabis in pharmacies or state-licensed shops in designated areas is being considered. The specific regions for the tests have not yet been decided. Some cities, such as Berlin, Bremen and Schwerin, have already shown their willingness to participate, while Bavaria has expressed strong opposition, fearing an increase in drug tourism. The projects to be carried out are to be scientifically supported, limited in time to five years and aimed exclusively at residents of these communities. The Federal Government emphasises that this phase should be carried out in consultation with the European Union.

- Previous convictions for possession of up to 25 grams or cultivation of up to three plants can be removed from the Federal Central Criminal Record upon request.
These are probably the most important points of the marijuana legalization project in Germany. The bill also mentions the prohibition of alcohol consumption in the above-mentioned cannabis clubs, about the minimum distance from schools or kindergartens, as well as bans related to smoking marijuana in public places and pedestrian zones.

In the coalition agreement, the SPD, Greens and FDP support the introduction of "controlled distribution of marijuana for adults for recreational purposes in licensed shops". The German police association notes, however, that the proposed project will not have a real impact on this state of affairs.
This second phase of the planned legalization of cannabis in Germany, however, is "presumably still subject to further legal action," according to the German government. This means that the European Union will most likely have to take a position on this matter. What will come of it in the end? This cannot be definitively determined at the moment.

We have lived to see the times when our western neighbors - Germany - want to legalize marijuana. On the basis of the coalition agreement, which has already been published, the topic of "drugs policy" is discussed on page 88. There, translated into Polish, we can read:

Germany is the first major European country to legalize
We deliberately write “largest”, because Luxembourg may gain the title of the first European country to legalize marijuana. In Germany, on the other hand, the agreement described above is the result of the work of the new, governmental coalition – the Free Democratic Party, the Greens and the Social Democratic Party of Germany. It was agreed that the possession, sale and consumption of marijuana will be accepted by German law.
German media already confirm - marijuana will be legalized

The sale and possession of cannabis for recreational purposes will soon be legal. In Germany, since 2017, only medical marijuana, available on prescription, has been legal. Meanwhile, the media are already writing about an amendment to the act that will allow for the controlled distribution of cannabis to adults. Of course, the sale itself will only take place in licensed stores. The assumption of such laws is largely to limit the influence of the black market while redirecting this capital to the state treasury. There is no shortage of various estimates related to this influence. Germany speculates that thanks to the legalization of marijuana in the scope described in the act, even over one billion euros will flow into the German state coffers annually.

Changing the way we look at marijuana consumers
The recent increased interest in the legalization of marijuana shows that the perception of the cannabis user is changing. He is no longer seen as a criminal. Finally, more and more people notice that smoking cannabis is not a crime, and that people who practice it are not harmful to society, such as people abusing alcohol. Our western neighbors have realized this, which is why the legalization process in Germany is entering into force before our eyes. When will we see similar legal moves in our own backyard? We don't know that yet.
