After talks with the Commission EurOpean The German government divided the legalization reform into stages. Changes regarding the legal sale of marijuana in specialized stores are to be implemented gradually.

Why do Germans want to legalize marijuana?

Still, one of the key arguments for the legalization of marijuana in Germany, which is given by the local government, is the desire to reduce the black market in marijuana, and the desire to make cannabis use safer.

The main assumptions of the marijuana legalization project in Germany of April 12.04.2023, XNUMX:

  • Possession of up to 25 grams of marijuana is not to be punished.
  • A maximum of three "female flowering plants" are to be allowed for indoor cultivation.
  • "Non-profit" associations with up to 500 members would be created, which could grow cannabis together for recreational purposes and sell it to members for personal use only.
    • Each member of the club would have a maximum of 25 grams of marijuana per day and a maximum of 50 grams per month. Persons under 21 years of age will receive a maximum of 30 grams of marijuana per month, with an upper limit for the content of the active substance.
  • Previous convictions for possession of up to 25 grams or cultivation of up to three plants can be removed from the Federal Central Criminal Record upon request.

These are probably the most important points of the marijuana legalization project in Germany. The bill also mentions the prohibition of alcohol consumption in the above-mentioned cannabis clubs, about the minimum distance from schools or kindergartens, as well as bans related to smoking marijuana in public places and pedestrian zones.

Legal sale of marijuana in Polandicecontrolled stores in Germany, i.e. plans for the second stage of the reform.

In the coalition agreement, the parties: SPD, Greens and FDP support the introduction of "controlled distribution of marijuana for adults for recreational purposes inicelisted stores”. In the autumn, proposals in this regard were presented by the German Minister of Health. It was feared from the very beginning that all these assumptions and plans could be thwarted by both EU and international law.

However, as provided for in the current act, it may be possible to carry out the so-called a pilot project allowing the sale of cannabis in Germany, which will only be possible in a small number of shops with a special licenation. The premise is that this trial should show the impact of the sale of cannabis on the German population and public health, as well as on the changes caused by it on the black market. However, the German police union notes that the proposed project will not have a real impact on this state of affairs.

However, this second stage of the planned legalization of marijuana in Germany is "presumably still subject to further legal action," according to the German government. This means that the Union EurThe European Parliament will most likely have to take some position on this matter. What will result from this in the end? This cannot be definitively stated at the moment.

We have lived to see the times when our western neighbors - Germany - want to legalize marijuana. On the basis of the coalition agreement, which has already been published, the topic of "drugs policy" is discussed on page 88. There, translated into Polish, we can read:

“We will introduce controlled distribution of marijuana to adults for consumption purposes in licelisted stores. This will control the quality of the cannabis, prevent the spread of contaminated substances and ensure the protection of minors. After four years, the relevant law will be evaluated in terms of its impact on society. We will enable and extend models of drug control and harm reduction measures."

“Wir führen die kontrollierte Abgabe von Cannabis an Erwachsene zu Genusszwecken in lizenzierten Geschäften ein. Dadurch wird die Qualität kontrolliert, die Weitergabe verunreinigter Substanzen verhindert und der Jugendschutz gewährleistet. Das Gesetz evaluieren wir nach vier Jahren auf gesellschaftliche Auswirkungen. Modelle zum Drugchecking and Maßnahmen der Schadensminderung ermöglichen und bauen wir aus.”

What will the marijuana legalization process in Germany involve?

As we read in the presented agreement, the coalition plans to control the quality of the dried herb introduced into circulation in order to introduce uncontaminated substances and solutions to the market that are to guarantee the protection of underage German citizens. The draft assumes that after four years this law will be reviewed in terms of its impact on society.

Germany is the first big country european who decides to legalize

We write "largest" on purpose, because Luxembourg may become the first eurEuropean country that will legalize marijuana. In Germany, however, the agreement described above is the result of the work of the new government coalition - the Free Democratic Party, the Greens and the Social Democratic Party of Germany. It was agreed that the possession, sale and consumption of marijuana would be accepted under German law.

German media already confirm - marijuana will be legalized

Der Spiegel, one of the largest German media, reported on November 18 that the new government is working on legalizing marijuana. The sale and possession of cannabis for recreational purposes will soon be legal. In Germany, since 2017, only medical marijuana, available on prescription, is legal. On the other hand, the media are already writing about the amendment to the law, which will allow for the controlled distribution of cannabis among adults. Of course, the sale itself will take place only and exclusively inclicentized stores. The assumption of this type of laws is largely to limit the influence of the black market while redirecting this capital to the state treasury. There are various types of estimates related to this impact. Germany speculates that thanks to the legalization of marijuana to the extent described in the act, even more than one billion euro will flow annually to the German state coffers.

Changing the way we look at marijuana consumers

The recent increased interest in the legalization of marijuana shows that the perception of the cannabis user is changing. He is no longer seen as a criminal. Finally, more and more people notice that smoking cannabis is not a crime, and that people who practice it are not harmful to society, such as people abusing alcohol. Our western neighbors have realized this, which is why the legalization process in Germany is entering into force before our eyes. When will we see similar legal moves in our own backyard? We don't know that yet.
